Mineral proprietorship
(BABWE)
Mineral proprietorship grant a person or a company the right to extract the mineral resource for which the mineral rights were awarded. Mineral proprietorship are entered in the mining register at the land registry office.
The search for economically relevant mineral resources such as hydrocarbons, anthracite and lignite, or potash and rock salts, and their production in the Federal Republic of Germany, are subject to the regulations of the Federal Mining Act (Bundesberggesetz - BBergG). Concessionable and non-concessionable mineral resources are differentiated. Non-concessionable mineral resources belong to the land owner. Land ownership does not extend to concessionable mineral resources.
Whoever aims to produce (extract) concessionable mineral resource requires a licence compliant with § 8 Mining Act or the mineral proprietorship compliant with § 9 Mining Act. These are issued by the responsible agency. In the states of Lower Saxony, Schleswig-Holstein, Hamburg, Bremen and on the continental shelf of the North Sea, this agency is the State Authority of Mining, Energy and Geology (LBEG). Both the licence and the mineral proprietorship grant the right to extract mineral resources within a given field. In addition, mineral proprietorship provide a property-equivalent right, that is, the property may be included in the land register and offered as security. The field covered by the licence or mineral rights is bounded on the surface and extends to infinite depth, that is theoretically to the centre of the Earth.
